Supreme Court - In Equity - John REID, JR.&c, vs. James E. UNDERHILL and
others.

In pursuance of a ......... order of this court made in the above cause,
bearing date the 19th day of December, 1848, I will sell at the Franklin
House, No. 15 Fulton street in the city of Brooklyn, on the 25th day of
January, 1849, at 12 o'clock at noon of that day, the following lands
and premises---
    All those four lots of land situate at Red Hook, in the Sixth ward
of the city of Brooklyn, in the county of Kings, distinguished on a map
of part of the property of Nicholas VAN DYKE deceased, dated January 15,
1835, and filed in the office of the Clerk of the county of Kings, by
the numbers 157, 158,159, and 160, fronting on VAN DYKE street, bounded
as follows: Beginning at a point on the southeasterly side of Van Dyke
street aforesaid two hundred and fifty feet from the westerly corner of
Van Dyke street and Conover street; running thence northwesterly along
Van Dyke street aforesaid one hundrend feet; thence southwesterly
parallel to Ferris street one hundred feet to the centre of the block;
thence southeasterly parallel to Van Dyke street aforesaid one hundred
feet; and thence northeasterly along lot No. 156 on said map one hundred
feet to the place of beginning - each lot being in width twenty five
feet front and rear and one hundred feet deep.  [welcome to land

    Also the half part of the streets adjoining said lots, subject to
the easement of the purchasers of the property on the said Nicholas VAN
DYKE, their heirs and assigns, until opened by due course of law;
together with the tenements, hereditaments and appurtenances thereunto
belonging.
    Also, all those eight lots of land situate at Red Hook, in the Sixth
ward of the city of Brooklyn, distinguished on a map of the property of
Nicholas VAN DYKE deceased, made by Roswell GRAVES, Jr., dated January
15, 1835, and filed in the office of the Clerk of the county of Kings,
by the numbers from one hundred and nine to one hundred and sixteen both
inclusive, and bounded as follows: Beginning on Elizabeth street one
hundred feet northerly from the northerly corner of Van Brunt and
Elizabeth streets; running thence northwesterly along Elizabeth street
two hundred feet; thence northeasterly at right angles with Elizabeth
street one hundred feet; thence southeasterly parallel to Elizabeth
street two hundred feet; thence southwesterly parallel to Van Brunt
street one hundred feet to Elizabeth street the place of beginning; each
lot being in width in front and rear twenty five feet, and in length on
each side one hundred feet; together with one half part of the streets
adjoining said lots, and between them the lines drawn through the
centres of said streets subject to the easement of the public when
opened by due course of law, and until so opened to the easement of the
purchasers at the public sale of the said testators' property, their
heirs and assigns; together with the tenements, hereditaments and
appurtenances thereunto belonging.

    Also, all those four lots of land situate at Red Hook, in the Sixth
ward of the city of Brooklyn, distinguished on a map of part of the
property of Nicholas VAN DYKE deceased, made by Roswell GRAVES, Jun'r,
dated January 15, 1835, and filed in the office of the Clerk of the
county of Kings, by the numbers from one hundred and eighty one to one
hundred and eighty four both inclusive and bounded as follows:
Beginning at a point on Van Dyke street one hundred  from the north
corner of Van Dyke and Van Brunt streets; and running thence
northwesterly along Van Dyke street one hundred feet; thence
northeasterly at right angles with Van Dyke street one hundred feet to
land late of Matthias VAN DYKE deceased; thence southeasterly along the
land of the said Matthias VAN DYKE one hundred feet; thence
southwesterly at right angles with Van Dyke street one hundred feet to
Van Dyke street, the place of beginning - each lot being in width twenty
five feet front and rear, and one hundred feet  deep on each side;  and
also the half part of the streets adjoining said lots between them and
the lines drawn through the center of said streets, subject to the
easement of the public when opened by due course of law and until so
opened of the purchasers at the public sale of the said Nicholas VAN
DYKE's property, their heirs and assigns; together with the tenements,
hereditaments, and appurtenances thereunto belonging.

Kings, by the numbers 24,25,26,27,28,29,30 and 31, fronting on Conover
st, and taken together are bounded b as follows to wit: Beginning at the
northeasterly corner of Reid and Conover street, and running
southeasterly along Reid street one hundred feet; thence northeasterly
two hundred feet to Elizabeth street; thence northwesterly along
Elizabeth street one hundred feet to Conover street; thence
southwesterly along Conover street two hundred feet to the place of
beginning; each lot being in width , in front and rear twenty five feet
and in depth on each side one hundred feet; and also those certain four
lots of land partly covered with water and lying together, and known on
the aforesaid map by the numbers seven, eight, nine and ten, and taken
together are bounded as follows, to wit:  northeasterly in front by Reid
street; northwesterly by Conover street and the Hudson River, south and
southwesterly by the Hudson River extending into the said river to low
water mark and southwesterly by the lot known by the number six;  and
also the half part of the streets adjoining the said lots and between
them and lines drawn through the centre of said streets, subject to
easement of the public when opened by due course of law, and until so
opened to the easement of all the purchasers at the public sale of said
property, their heirs and assigns; together with the tenements,
hereditaments and appurtenances thereunto belonging.
    Also, all those four certain lots of land situate at Red Hook in the
Sixth ward of the city of Brooklyn aforesaid, laid down on a map of part
of the estate of Nicholas VAN DYK[E], made by Roswell GRAVES, Jun'r, and
filed in the office of the Clerk of the county of Kings, March 16, 1835,
and numbered from one hundred and thirty seven to one hundred and forty
both inclusive, and bounded as follows---Beginning at the corner of Van
Dyk and Conover streets and running thence southwesterly along Conover
street one hundred feet to lot numbered one hundred and thirty six;
thence northwesterly at right angles with Conover street along said last
mentioned lot one hundred feet;  thence northeasterly parallel to
Conover street one hundred feet to Van Dyk street; thence along Van Dyk
street southeasterly one hundred feet to the place of beginning, and
said lots being each one hundred feet in length and twenty five feet in
width; also, the one half of Van Dyk and Conover streets adjoining said
premises and between them and lines drawn through the centre of said
streets, subject to the easement of the public over the said streets
when opened by due course of law and until so opened to the easement of
all the purchasers at the public sale of said Nicholas VAN DYK's

the Sixth ward of the city of Brooklyn, laid down on a map of part of
the estate of the said Nicholas VAN DYKE, made by Roswell GRAVES, Jun'r,
and filed in the office of the Clerk of the county of Kings, March 16,
1835, and numbered from one hundred forty seven to one hundred and fifty
both inclusive, and bounded as follows:  Beginning on the north side of
Elizabeth street at a point distant two hundred and fifty feet, westerly
from Conover street, and running thence northwesterly along Elizabeth
street one hundred feet to the Hudson River at low water mark; thence
northeasterly at right angles with Elizabeth street one hundred feet;
thence southeasterly and parallel with Elizabeth street one hundred feet
to lot number one hundred and forty six; thence southwesterly at right
angles with the last line one hundred feet to the place of beginning;
said lots being each one hundred feet in length and twenty five feet in
breadth; also the one half of Elizabeth street adjoining the said
premises and between them and a line drawn through the centre of the
said street subject to the easement of the public when opened by due

Dyk and Van Brunt streets; and running thence northwesterly along Van
Dyk street two hundred feet to Conover street; thence northeasterly
along Conover street one hundred feet to land late of Matthias VAN DYK
deceased;  thence southeasterly along the land late of the said Matthias

NEW YORK SUPREME COURT - Joshua TOMLINSON and Chalkley J. WILLS against
Allen CLARK, Emily his wife, and others, defendants.  Summons in
mortgage cases.
    To Allen CLARK, Emily his wife, Charles WEAVER and Jay McDONALD,
four of the defendants in the above entitled suit.---
    You are hereby summoned to answer the complaint in this cause and
serve a copy of your answer on me at No. 53 Wall street, in the city of
New York, within twenty days after the service hereof, exclusive of the
day of such service, and if the defendants fail to answer the complaint
as aforesaid, the plaintiffs will apply to the court at the City Hall in
the city of New York, on the twenty-fourth day of February, one thousand
eight hundred and forty nine, at ten o'clock in the forenoon, for the

EXAMINATION OF BURGLARS - Henry EARLE, William EARLE, William TEASE, and
Isaac JAMES, the four burglars who have been satisfactorily connected
with a series of robberies at churches and stables in this vicinity,
were partially examined yesterday before Justice GARRISON.  The pastors
of the churches and the individuals who have been robbed, were present,
and identified the stolen property.  The prisoners were remaned for
further examination to-morrow.

IN SUPREME COURT - In Equity - James TALLMADGE vs.  Cornelia A. JACKSON
and others.
    In pursuance of a decretal order of this court made in the above
action, bearing the date 21st February, 1848, I will sell at public
auction at the Franklin House, No. 15 Fulton street in the city of
Brooklyn, on the eighth day of January next, at 12 o'clock at noon of
that day, the following lands and premises, or so much thereof as may be
necessary to satisfy the said decree, viz:
    All those twenty two lots of land situated in the city of Brookly,
and known on a certain map filed in  the office of the clerk of the
county of Kings on 29th September, 1849, entitled "map of property in
the city of Brooklyn, belonging to the heirs of John JACKSON, deceased,"
dated Brooklyn, May, 1839, surveyed by Silas LUDLUM, city surveyor, by
the numbers in numerical figures from 365[three hundred and sixty five]

hundred and six] to 416 [four hundred and sixteen] inclusive, and which
taken together are bounded as follows:  beginning on the west side of
Hampden street 192 feet south from DeKalb avenue as laid down on said

map in a straight line 200 feet to the east side of Canton street,

GRAND JURY - The grand jury assembled this morning for the consideration
of the business claiming their attention.  The following gentlemen
compose the grand inquest:

We notice among them some gentlemen who have been drawn on the grand
jury a half dozen times within half as many years.  How is it that these
gentlemen have to perform this onerous duty so often, in view of the
large number of tax payers in this city and county?  We should think
that some change ought to be made once in a while in the grand jury
list, in order to equalize the duty among those who ought to perform it.

14 February 1849
KINGS COUNTY OVER AND TERMINER --
In this court yesterday, before Judge MORSE and Justices HUGHES and
WRIGHT, the following business was disposed of:

Samuel BROWN was arraigned for assault and battery with intent to kill,
and pleaded not guilty.  A nolle prosequi was entered in the case of
James A. HUGHES, indicted for false pretences.  John GILLESPIE withdrew
his plea of not guilty to an indictment for illegal voting, pleaded
guilty and was sentenced to pay a fine of six cents.  Edward JOHNSON was
tried and convicted of assault and battery on David BROWN, and sentenced
to ten day imprisonment in the county jail.  John CONNOR was tried and
convicted of assault and battery, but sentence was suspended.  Alexander
MOLLET was tried on an indictment for assault and battery upon William
GALLAGHER with a deadly weapon.  The jury after an absence of some two
hours rendered a verdict of not guilty.  John TRAINOR appeared in court,
withdrew his former plea of not guilty to an indictment for false
pretense, and pleaded guilty.---sentence was ordered to be suspended.

The grand jury in the course of the day made their first return into
court and presented a batch of indictments for all manner of offences,
among which were fourteen against the church burglars, Henry and William
EARLE.  They were arraigned and William EARLE pleaded guilty to each of
them, while Henry pleaded not guilty.  There were four indictments
against Jack FOX, alias REYNARD, a genteel whiskerando, for arson and
burglary.  He pleaded not guilty.  George and Barbara HACK and Joanna
SCHALL, of Williamsburgh, indicted for grand larceny, severally pleaded
not guilty.  The grand jury, after reporting these indictments, retired
for the purpose of resuming their session.

The court of oyer and terminer was in session this morning, but up to 12
o'clock had taken up no cases for trial, in consequence of the district
attorney being engaged with the grand jury.  On Monday next Judge MORSE
will open the Putnam county 'oyer and terminer'*.

15 February 1849
OYER AND TEMINER - Judge MORSE, presiding. The Grand Jury again came
into court , and presented bills of indictment against Eliza HICKS,
Patrick KENNEDY, Michael REYNOLDS and Keenan BRENNAN, for robbing John
P. LOTT, of his watch and chain and other articles;  also, against Wm.
MOORE, for receiving stolen goods.  MOORE was arraigned at the bar and
pleaded guilty to the charge against him.  Christian LIE was put upon
his trial, on a charge of burglary in the 2d degree.  John DONNELLY,
indicted for committing a violent assault and battery, with intent to
kill, upon officer ECKHARDT, was put upon his trial.

18 February 1849
OYER AND TERMINER.-- The jury acquitted John DONNELLY, who was tried for
assault and battery upon officer ECKHARDT with intent to kill, but
convicted him of the assault.  Yesterday, John LANGSTAFF was tried and
acquitted of keeping a disorderly house in Myrtle avenue.  Patrick
KENNEDY, one of the parties implicated in the robbery of John P. LOTT,
was tried and acquitted.  The trial of the persons implicated in the
robbery at HACK's tavern, was postponed until next term.  To day was set
down for the trial of the indictments growing out of the alleged
nuisances around MAULAY's distillery.

OYER AND TERMINER..
This court was engaged yesterday in trying an indictment for nuisance
against John BULLWINKLE, one of the persons indicted for keeping
offensive cow stables and pig pens in the vicinity of MANLEY's
distillery, corner of Gold and Tillary  streets.  After hearing the
testimony of Rev. Mr. SPRAGUE, Ald. HALL, and Dr. GOODRICH, physician to
the Board of Health, the jury found sufficient in it to render a verdict
of guilty.

19 February 1849
OYER AND TERMINER .--- On Saturday, in this court, Judge MOORE
presiding, Patrick KENNEDY, Michael REYNOLDS, and Keenan BRENNAN were
tried for assault and battery on John P. LOTT.  The first was aquitted
but the last two were convicted and sentenced to pay a fine of $50
each.  The following prisoners were sentenced as follows:  Henry EARLE,
the church burglar, was sentenced to ten years and two months, and his
brother, William EARLE, to four years and two months in state prison.--
Christian LEE, for burglary in the second degree five years in state
prison.  Henry HANDMERE, for petit larceny, second offense, two years in
the state prison.  Hannah PASSAN, colored, for attempt to poison a
family at Flatbush, ten years in the state prison.  John DONNELLY, for
assault and battery on an officer, six months in the county jail.  Henry
FREEMAN, petit larceny, three months in the county jail.  Peter McCANN,
for selling liquor without a license, a fine of $25.
The court has adjourned, sine die.

SUPREME COURT -  Rodney S. CHURCH against James SAMS and others.
In pursuance of a judgment order of this court made in the above
entitled cause, bearing date the seventeenth day of February, 1849, I
will sell at the Franklin House, No. 15 Fulton street, in the city of
Brooklyn, on the 13th day of March, 1849, at 12 o'clock at noon of that
day, the following lands and premises-----
    The indenture of lease bearing date the fifteenth day of February in
the year one thousand eight hundred and forty seven, made by Michael
CORBETT, physician to the said John MARTIN, for all that certain
dwelling house, store and lot of land situated at the corner of Hicks
and Atlantic streets, in the city of Brooklyn, county of Kings, running
thirty feet on Hicks street and forty-five feet on Atlantic street on a
line with the street with the appurtenances for the term of seven years
from the first day of May one thousand eight hundred and forty-seven, at
the yearly rent or sum of four hundred and seventy-five dollars, to be
paid in equal quarter yearly payments.  And also the indenture of lease
bearing date the thirtieth day of March, one thousand eight hundred and
forty-seven, between the said John MARTIN and one John McGRATH for all
that certain lot of land, together with the frame building thereon,
erected and situate on Atlantic street in said city of Brooklyn, next to
the corner of Hicks street, containing in front on Atlantic street
twenty feet and in depth twenty-two feet, be the said dimensions more or
less with the appurtenances for the term of seven years from the first
day of May, one thousand eight hundred and forty-seven, at the yearly
rent or sum of two hundred dollars to be paid in equal quarter yearly
payments.  And also the agreement or certificate of lease, by which
dated the fifteenth day of March, 1848, the said John MARTIN let and
rented unto John HARGRAVES the privilege of building a pointer's shop
over the front shed or roof of the house on the corner of Atlantic and
Hicks streets, Brooklyn, being about twenty feet front and rear up to
John McGRATH's house on Atlantic street, and about thirteen and a half
feet from the front piazza back to the gable end of the cottage fronting
on Hicks street, with a privilege of a flight of steps up to the same on
the Hicks street side, and also with the privilege of removing said shop
and steps at the expiration of said lease unless paid for by the
landlord to the satisfaction of the owner of said shop and steps, for
the term of six years to commence the first day of May then next, at the
yearly rent of thirty dollars, payable quarterly thereafter.
    Together with all and singular the edifices, buildings, rights,
members, privileges and appurtenances thereunto belonging or in anywhere
appertaining.  Dated Brooklyn, February 19th, 1849.

SUPREME COURT - In Equity---Leffert G. COLES, vs Rodney S. CHURCH, et
al.                   W.K.THORN, Solicitor
In pursuance of a decretal order of this court made in the above cause,
bearing date January 23d, 1849, I will sell at the Franklin House, No.
15 Fulton street, in the city of Brooklyn, on the 19th day of February,
1849, at 12 o'clock at noon of that day, the following lands and
premises---
        All those certain lots known and distinguished on a map of the
property of Jordan COLES, situated in the city of Brooklyn, on the 17th
day of December 1834, filed in the office of the clerk of the county of
Kings as lots numbers 840,841,842,843,844,845,846,
847,848,849.850,851,852,853, fronting on Centre street on the said map;
and also all the right, title and interest of the parties of the first
part in and to the adjoining half part of the streets on which said lots
are situated, being together sixteen lots and 1385 superficial feet.
        And also all those certain other lots known and described on the
said map as lots numbers 864,865,866,867,868,869,870,871,873,874,875,876
on Mill street on said map;  and also lots numbers 877,878,879,880 on
Clinton street; and also all the right, title and interest of the said
parties of the first part in and to the adjoining half part of streets
on which said lots are situated.  Being seventeen lots except such part
of the said lots as have been taken by  the opening of Hamilton avenue
through the said premises.  Etc,etc,etc...

FIRE - A three story brick building belonging to Danniel MORRISON,
between Myrtle avenue and Tillary street, was burnt to the ground last
night about 11 o'clock.  It had been erected on the site of a building
which was burnt down last fall.  There is little doubt that is was the
work of an incendiary.

21 February 1849
SUPREME COURT - Whereas, Jeremiah O'DONNELL of the city of Brooklyn, did
by a certain indenture of mortgage bearing date the twenty-fifth day of
February in the year one thousand eight hundred and forty five, for
securing the payment of the sum of five hundred and ninety four dollars
on the 25th day of February, which would be in the year one thousand
eight hundred and forty seven, and the interest thereon at and after the
rate of six percent per annum, to be paid semi-annually from the date of
said mortgage, grant bargain, sell, convey, and confirm unto Oscar COLES
and William K.THORN of the city of New York "all those certain lots,
pieces or parcels of land known and distinguished on a map of the
property of and belonging to the estate of Jordan COLES deceased,
situated in the city of Brooklyn, filed in the office of the clerk of
the county of Kings as lots numbers [492-495, 512-515 inclusive];  and
also those certain other lots or gores* of land known and distinguished
on said map by the numbers 484-487, said last four lots together
containing two lots and one hundredth of a lot of twenty five hundred
square feet; and also those certain other lots, pieces and parcels of
land, known and distinguished on said map by the numbers 516-519, on
Centre street on said map; and also, lots numbers 489-491 on Hamilton
avenue and in the rear of said last mentioned lots on said map said lots
containing together five lots and sixty-five hundredths of a lot of
twenty five hundred square feet."  This mortgage being given on a sale
of said premises to secure a part of the consideration money on said
sale;  and also all the right, title and interest of the party of the
first part in and to the adjoining half part of the streets on which
said lots are situted.  Together with all and singular the tenements,
hereditaments and appurtenances thereunto belonging or in any wise
appertaining, and the reversion  and reversions remainder and
remainders, rents, issues, and profits thereof, which mortgage was duly
recorded in the office of the Clerk of the county of Kings in liber No.
98 of mortgages, page 422, on the 1st day of October, 1845, at 20
minutes past 4 P.M.
            And whereas, the said Oscar COLES and William K.THORN on the
fifteenth day of November, in the year 1845, duly assigned, transferred
and set over unto Cordelia COLES the said mortgage,  together with the
bond accompanying the same, which assignment was duly acknowledged and
recorded in the office of the Clerk of the county of Kings on the 8th
day of December, 1845.
            And whereas the said Cordelia COLES has, since the execution
of the said assignment, departed this life after having duly made and
executed her last will and testament;  and whereas, Frederick W. HURD,
sole acting executor, &c, by assignment bearing date the 12th day of
October, 1848, did assign , transfer and set over unto Charles W. LYNDE
the said mortgage, together with the bond accompanying the same, which
last named assignment was duly acknowledged and recorded in the office
of the Clerk of the county of Kings, on the 13th day of October, 1848;
and whereas default has been made in the payment of the said money
secured by the said mortgage, and theis is due thereon at this day,
being the time of the first publication of this notice, the sum of six
hundred and forty-six dollars and eleven cents.
            Notice is therefore hereby given, that by virtue of the
power of sale contained in the said indenture of mortgage, and in
pursuance of the statute in such case made and provided, the said
mortgaged premises will be sold at public auction.

LEGAL NOTICE

WHEREAS Henry DOBSON and Mary Ann his wife, of the city of Brooklyn, by
a certain indenture of mortgage bearing date the first day of July 1848,
for securing the payment of the sum of one thousand three hundren and
seventy five dollars on the first day of May, which will be in the year
1852, with the interest thereon  at and after the rate of six per cent
per annum, to be computed from the first day of July 1848, payable
semiannually on the first day of November and May in each and every
year, with the express agreement that if default should be made in the
payment of the said interest or any part thereof on any day whereon the
same should become payable, and should the same remain unpaid and in
arrear for the space of fifteen days, then after the lapse of fifteen
days the whole principal sum of one thousand three hundred and
seventyfive dollars with all arrearages of interest thereon should
become and be due and payable immediately thereafter at the option of
the party of the second part to said mortgage, his executors,
administrators or assigns, although the time limited for the payment
thereof might not have expired, did grant, bargain, sell, convey, and
confirm unto John CASSIDY of the city of Brooklyn,[party of the second
part to the said indenture of mortgage] "All those eleven lots, pieces
or parcels of land situate, lying and being in the Seventh Ward of the
city of Brooklyn, and know and distinguished as follows on the map of
the NOSTRAND farm now on file in the office of the clerk of the county
of Kings, to wit--three lots on the westerly side of Sandford street
beginning 88 feet 4 inches from the southwesterly corner of Wallabout
Bridge Road and said Sandford street, 25 X 100 feet.
    Also, four lots on the westerly side of Nostrand avenue, beginning
100 feet from the southwest corner of Tillary street and Nostrand
avenue, each 25 X 100 feet.  And also, four lots on the easterly side od
said Sandford street beginning one hundred feet from the southeast
corner of Tillary street and Sandford street, each 25 X 100 feet, know
and distinguished as aforesaid on said map of the NOSTRAND farm by the
numbers 162,161,160, 476-479, 428-431 on said map, which said mortgage
was recorded in the office of the Clerk of the county of Kings in liber
140 of mortgages, page --, on the 16th day of November 1848, at ten
minutes past ten o'clock, A.M.; and bearing date the 1st day of July
1848, assigned and set over by the said John CASSIDY to James
CUNNINGHAM, which assignment was recorded in the office of the Clerk of
the county of Kings in liber 140 of mortgages, page --, on the 16th day
of November 1848, at 10 minutes past 10 o'clock, A.M.
    And whereas default has been made in the payment of the interest on
the said principal sum of one thousand three hundred and seventy five
dollars, which interest became due and payable on the first day of
November 1848; and whereas more than fifteen days have elapsed since the
said interest became due and payable and the same still remains due and
unpaid; and whereas the said James CUNNINGHAM has made his election that
the whole of the principal sum of one thousand three hundred and
seventyfive dollars secured to be paid by the said mortgage, together
with all arrearages of interest thereon shall become and be due and

BOUND OVER FOR TRIAL -- Officer S.B. HICKS was examined yesterday by
Justice GARRISON on the charge of striking John DOOLEY on the forehead
with a "dummy."  The magistrate, held him to bail in $300 for his
appearance at the oyer and terminer on a charge of aggravated assault
and battery.

    To Thomas WHITE, Jr. and Elizabeth his wife, Henry VYSE, Richard
VYSE, Thomas VYSE, George A. SCOFIELD and Horace B. KINGSLEY:  You are
hereby summoned to answer the complaint in this cause, and serve a copy
of your answer on me at my office No. 28 Beekman street, in the city of
New York, within twenty days after the service hereof, exclusive of the
day of such service;  and if the defendants fail to answer the complaint
as aforesaid, the plaintiff will apply to the court at a special term
thereof to be held at the City Hall in the city of Brooklyn on the first
Tuesday of June next, one thousand eight hundred and forty nine, at 10
o'clock in the forenoon, for the relief demanded in the complaint.
