FORGERY OF A WILL
BERGEMAN and HILDEBRAND will be sentenced to-morrow for subornation of
perjury, in procuring witnesses to swear to the forged will of
John Philip BAUN.
It will be remembered that about a month ago A.C.B. BERGEMAN and Anthony
HILDEBRAND were tried and convicted on a charge of subornation of perjury, in
that they had procured Emil GOLDSTEIN and Otto ARNOUX to swear falsely to the
execution of a forged will, purporting to be the will of John Philip BAUN, of
East New York.
Before the trial, Messrs. MOORE, GILL, and HINSCH, of counsel for the
prisoners, raised questions as to the right of the City Court to try the
prisoners, and during the course of the many objections were made to the
receipt of certain evidence that was offered. Judge McCUE who presided at the
trial held at the time that the City Court had jurisdiction in the matter,
and overruled most of the objections made by the counsel.
After the conviction, a motion in arrest of judgment was argued, on the
ground that the court had not jurisdiction, and on the ground that the
objections were improperly overruled. The argument was before Judge McCUE,
and it is understood that he will to-morrow morning, render a written opinion
denying the motion, and at the same time the prisoners will be sentenced.
