ALIMONY AND COUNSEL FEES
A preliminary motion for alimony and counsel fees by counsel for the defendant
in the case of John M. Bishop vs. Margaret V. Bishop was argued before Justice
Pratt in the Supreme Court this morning, and decision was reserved.  The case is
one in which suit was brought by John M. Bishop for divorce from his wife on the
ground of improper conduct on her part.  The action was begun in Columbus
County, but a change of venue was obtained.

SENT TO THE ASYLUM
A number of applications for commitment orders for alledged
lunatics were considered by Judge VAN WYCK in the City
Court yesterday, and applications granted in the following cases:
	HOLIHAN, John, 35 years of age, who came to this country from 
Ireland on July 1. He enlisted in the United States Army and was 
sent to Washington, D.C., but subsequently he was discharged.
He then came to Brooklyn and has been deranged since.
	DEEGAN, Mary, aged 20, who resided at 145 Park Avenue, 
was ordered to be committed to the Kings County Insane Asylum.
She has only been in the country 14 months, having come from Ireland. 
She harbors the delusion that her housekeeper wants to poison her, 
and is continually talking about prudent young men and her 
appreciation of them.
	LAMB, Ellen, 30 years of age, is also a native of Ireland
She resided on Brooklyn for the past 5 years, and is troubled
with a hallucination that clergymen of all denominations have
designs upon her with a view to making her become a nun, and for
that purpose are preventing her from obtaining employment. She
will be sent to the Kings County Asylum.
Commitment orders were also made out for:
	KRINES, William, an Austrian, aged 51 years.
	COLGAN, Mary, an Irish woman, who has been residing in Brooklyn
for thirty yearsand is suffering from dementia consequent upon 
extreme old age.
	WATERS, Ellen, aged 30, 217 20th Street.
	LOWE, Frank M., aged 19 years, who comes from New York.

The suit of Phillip KRETCHMAR against the city of Brooklyn for
$500 damages, alleged to have ben sustained through the flooding 
of his premises at 501 Broadway, E.D., from 1882 to 1884, came to trial
in the City Court, before Judge Van WYCK to-day. 
Messers. DAILEY and BELL were counsel for the plaintiff, who was

5 September 1889
Dilworth CHOATE, and the young newspaper man who was arrested
by Officer KANE on the Brooklyn Bridge Wednesday last on the
charge of disorderly conduct, appeared at the 
Tombs Police Court, New York today for examination. 
The policemn & Choate had a talk together and made friends. 
The case was dismissed.

Arraigned for Murder
William BALL, the young colored man who stabbed Sherman PORTER, also
colored, at a dance at No. 137 Bleecker street, New York, on the night of
Aug. 20, was brought before Judge GILDERSLEEVE in Part I of the General
Sessions this morning to plead to the charge of murder in the first degree.
He pleaded not guilty and was remanded for trial.

7 September 1889
In the damage suit brought by Father Francis DENT against 
Bishop RYAN for $100,000 for alleged slander. 
Justice DYCKMAN in the Supreme Court this morning ordered that 
places be specified, but not the name.

10 September 1889
Peter HAYER, who on the 31st of September almost killed his wife
with an ax, was admitted to bail by Justice KENNA this morning.
The house surgeon of St. Mary's sent a letter to the justice
in which he stated that Mrs Hayer had recovered and would
be out in a few days.

The will of Fritz JANSEN was admitted to probate by 
Surrogate ABBOTT. Mr. Jansen was a tailor and some 40 
years ago bought out Germania Hall, in Montrose avenue and Leonard
street, Eastern District, and after a short time amassed wealth 
amounting to $35,000. Subsequently he sold the hall and went
into the real estate business. In 1884 he visited Germany in company 
of his wife, and returned in 1887, shortly after which Mrs. Jansen
died. In 1888 Mr. Jansen again visited Germany, and made his will 
on May 24 at the American Consulate, Hanover. He died on May 30.
By the terms of the will, the esteate is left to the children
of his brothers and sisters, the three children of Mrs. Sophia WINTER, 
of Brooklyn and her adopted daughter, Mrs. Mamie SCHMIDT. An action 
is about to be commenced in the Supreme Court in behalf of Mrs. Schmidt,
claiming that she is entitled to one-third the entire estate. 
Louis Jansen and John Winters, executors of the will, recieve $10,000, the
insurance on Mr. Jansen's life.

Letters of Administration on her husband's estate have been taken out
by Mrs. Mary LUCA, widow of Grocer LUCA, who was recently killed by
burglar McLIVAINE. She has sold the grocery store at Jay & High streets 
for $3,000.

WANTS A DIVORCE
An Action Against Dr. HAGERMAN of Ridgewood.
In the Supreme Court this morning, before Judge CULLEN, Hannah HAGERMAN,
wife of Dr. Frederick HAGERMAN, who was for a number of years a well-known
and extensively  patronized physician of Ridgewood, Queens County, brought a
suit for absolute divorce on ground of infidelity.

Had Sugar in Their Boat
James HILL, of 353 Hicks street, James O'BRIEN, of 52 Congress street; John
SMITH, of 34 Columbia street, and Frank LOE, of 11 State street, this city,
were arrested by harbor police last night in a skiff in which was a large
quanity of sugar, supposed to have been stolen. They were discharged by
Justice HOGAN, at the Tombs police court, New York, as there was no evidence
against them.

Divides His Property
The will of Edmund DRIGGS was admitted to probate in the Surrogate's Court
to-day. The testator leaves a fourth of his estate to each of his three
sons, and the remainder is to be divided amongst the three children of his
deceased son, Edward. The executors are S.M. MEEKER and J.G. JENKINS.

Contractor WHITE.
Contractor Willaim WHITE, who resides at South Eighth street, E.D., has sued
out a writ of habeas corpus to oblige his wife to give up possession of her
children whom, he alleges she does not take proper care of. Mrs. WHITE
apperared in the City Court this morning, but was unable to obtain
professional representation. Judge OSBORNE adjourned the motion.

Four Months for Stealing a Shirt.
John O'NEIL was charged before Judge KENNA this morning with stealing a
shirt. Avon WERTHERIM, of 687 Broadway, who made the complaint, said he
valued it at 80 cents. He was sentenced to four months' imprisonment in the
Penitentiary.

Miss MEADE's Will
A Number of Catholic Clergymen and Institutions Among the Beneficiaries.
Surrogate ABBOTT admitted to probate to-day the will of Miss Rose MEADE, who
died on June 29. She leaves $200 for a tombstone, and allows sums of from
$100 to $300 to her brothers and her sisters, two of whom are members of
religious orders. Her nephew, Father Joseph DUNNE, of Newark, N.J., gets
$200, and Father Edward MCGOLDRICK gets $500. She also wills small sums to
several Catholic institutions. Her brother, Patrick MEADE, is to receive
$1,000 on condition that he surrenders a sum which lies in the bank in the
joint names of himself and his deceased sister.

The Mowrey Case.
The case of Mary MOWREY against her husband, Henry W. MOWREY, was on for
hearing in the Supreme Court. The suit is brought for separation on grounds
of ill-treatment and failure to suport. There was no appearance for the
defendant, who, the plaintiff's lawyer stated, had gone to Philadelphia to
avoid paying alimony.
Juldge CULLEN said that, as an answer had been served, the case should be
set down for trial at the October Special Term.

11 September 1889
Consented to Marry the Widow.
George SPOKAN, a Hungarian, 25 years of age, was married by Justice EAGLE
to-day to widow Susie WREISING, of 216 Second street, New York. SPOKAN met
the woman at a wedding about a year ago. He asked her to marry him and she
consented. When the time for the wedding came around the groom was not on
hand. After repeated efforts to get SPOKAN to marry her the widow caused his
arrest. A night in a station house cell convinced SPOKA that marriage was
discretion.

Stolen Property In Their Possession.
On the 9th inst. a horse and buggy which was standing in front of the City
Hall suddenly disappeared while its owner was engaged in business. Complaint
was made and an alarm sent out, and this morning Patrolman FRY, of the
Thirteenth precinct, arrested John WAHLFORTH, 17 years old of 196 Jefferson
street, and Michael SIEBERT, 15 years old, of 144 George street, who were
found with the property in their possession. It belonged to Gustave SPEIGLE,
of the Budweiser Brewing Company.

18 September 1889
Again in Prison-Thomas REILLY, the bootblack who is familiarly known
by his associates about Fulton Ferry as “Mud” RIELLY, went
on a little spree last night and created such a disturbance
that he was arrested. He will serve at Crow Hill for the next
six months because of Justice PETTERSON’s sentence this morning.

19 September 1889
Sent to the Penitentiary
John CONNORS was arrested on complaint of his wife Lizzie, 
of Tenth Avenue and Braxton Street, who accused him of
beating her. In court this morning Mrs. CONNORS presented
a rather bruised appearance. She said she had received but $10
from her husband in five months. Justice TIGHE sent him to
the Penitentiary for 100 days.

21 September 1889
A Gambling House Raided
Patrick MACKEY, who was arrested last night charged with
keeping a gambling house at 142 East Fourteenth Street, New
York, was held for trial by Justice DUFFY at the Essex Market
Police Court this morning.
Henry HOWARD, the dealer, was fined $10. 
Seven inmates,named 
Horace SMITH, 
John DALY, 
Thomas BYRNES, 
Frank BROOKS, 
Thomas JONES, 
Patrick FARRELL, and Joseph CLARK were fined $5 each.
The fines were paid and MACKEY furnished bail for his 
appearance at the trial.

25 September 1889
McElvaine’s Trial
District Attorney RIDGWAY has notified Mr. CURTIS, consul
for Charles McELVAINE, accused of the murder of Grocer
LUCA, that he will move in the Court of Sessions to fix the
trail for Oct. 7.

He Did Not Die
But Alleges that His Heirs Objected to Being Disappointed in Their
Expectations.
Some time in March, 1885, Conrad STUBING, who lived at No. 23 Cook street,
this city, was taken sick, and, believing himself nigh unto death, desired
to dispose of his property. For this purpose he called in a certain
Commissioner of Deeds and told him to draw up papers by which John STUBING,
his son, should become the owner of the house and lot on Cook street on the
death of the father, providing that he permitted his mother to make her home
there during her life. John was also to divide $1,000 between his two
sisters, to obtain which sum a mortgage was to be given upon the property.
The drawing up of the papers was bunglingly executed, but a deed was
executed conveying the house and lot to the son John, it being agreed that
this should remain in the possession of the father until his death. But that
event did not transpire, as had been anticipated , and Conrad STUBING is
to-day well and hearty. He was in the City Court yesterday as a complainant
against his son, who, he alleged, had unwarrantably obtained possession of
the deed above mentioned, and had also taken possession of the property. Mr.
STUBING also complained that his family had drawn from bank $700 which he
had entrusted to their care and deposited in another bank. He asked the
court that he be again put in possession of his property and funds. After a
careful hearing of the facts in the case, Chief Judge CLEMENT gave judgement
in favor of the plaintiff.

The Grand Jury was then impaneled. Judge MOORE, in charging the
body, said he did not anticipate they would have much work because the
preceding Grand Jury had performed all the work to clear the cases, and
the fact that the people of this county were orderly and law-abiding
made it comparatively easy to administer justice and to keep up with the business.

   All the members of the petit jury wanted to be excused despite the
fact the Judge said he would excuse none. The Judge looked over the
crowd that gathered in front of him and said: I am here to administer
justice and I intend to do it. I am not going to block the wheels of
justice by excusing you. You can go take your seats. I am sick and tired
of this business.  Every morning this spectacle of respectable citizens
trying to escape doing their duty as jury duty is repeated.  I am
desirous of being accommodating, but I am sick and tired of being
imposed upon and I won’t stand it. You can take your seats.
The jury thus sat upon took their seats.
The following men were then arraigned:

Augustus HOFFMASTER, grand larceny.  He pleaded guilty. He said he came
from Cincinnati a year ago and went to work for Mrs. PETTIGROVE at Coney
Island.  He stole her watch and then went back to Cincinnati.
Unfortunately he returned to New York last month, was seen and arrested.
He was remanded for sentence.

Michael BOLOLO, an Italian, was charged with biting John LYNCH’s ear
off. He pleaded not guilty to a charge of assault in the second degree.

Rafanio PISIANI, another Italian, was charged with having practiced with
the wrong end of a pitchfork on John SHERIDAN, into whose body he shoved
the tines. He also pleaded not guilty.

Max GOLDBERGER and Chas. SCHWARTZ, charged with having kept a Coney
Island disorderly house, pleaded not guilty.  They will be tried next
week.

Michael PROUTTY and Joseph BANNON failed to appear to answer a charge of
robbery and their bonds were forfeited.

Michael FRISCH charged with manslaughter in the second degree, pleaded
not guilty and his case was adjourned indefinitely.  He is charged with
having thrown Patrick DOOLEY into the East River because he stole a keg
of beer.  DOOLEY was drowned.

His Bonds Forfeited
